ASPPA Webcast: RMDs Are Back in 2021

Description: The CARES Act suspended the required minimum distribution (RMD) rules for defined contribution plans and IRAs for 2020. The rules apply in 2021, and we must now prepare to apply the RMD rules as modified by the SECURE Act. We focus on the implementation of these new rules and discuss the impact and application of the new life expectancy tables that must be used in 2022.

ASEA Webcast: DB Provisions of the American Rescue Plan of 2021

Description: Tucked away in the American Rescue Plan of 2021 are changes to Internal Revenue Code Section 430 rules for defined benefit single-employer minimum funding valuations. These changes include relief with respect to segment rates and changing the amortization period from 7 to 15 years for shortfall amortizations. The provisions have different default and optional effective dates. We discuss these changes, including employer elections, with respect to the effective dates, interplay with the AFTAP rules under Code Section 436 and other plan document issues.

And the tax and exceptions also are discussed, since the additional 10% tax for early distributions leads to many inquiries from employers and employees.

Description: Non-safe harbor 401(k) plans still exist and they must test for nondiscrimination annually, whether it’s a small or large plan. To test for nondiscrimination, the Internal Revenue Code requires a 401(k) plan to test deferrals under the actual deferral percentage test (ADP) and matching contributions, if any, under the actual contribution percentage test (ACP). While the tests are generally straightforward, they do feature tricks, traps and opportunities for the practitioner. This program focuses on both ADP and ACP testing and correcting their failures, including by catch-up recharacterization.
