Department of Labor's Voluntary Fiduciary Correction Program

The Department of Labor has a Voluntary Fiduciary Correction Program (VFCP) for fiduciaries to correct potential violations of ERISA.  Hear the latest on the VFCP, including the most common fiduciary breaches, their corrections and whether it ever makes sense to correct outside of the program. The potential prohibited transaction excise tax implications and, the filing of IRS Form 5330 will be discussed. This session will be presented by Audrey W. Chan, Investigator with the DOL and Regional Co-Coordinator of the Voluntary Fiduciary Correction Program, and Brad Huss of Trucker Huss.

Continuing Education Changes for RECORDED Webcast Attendees
Once registered, attendees will receive a confirmation letter directing them to the “Access Recorded Webcasts” page with a link to the WebEx OnDemand Center. Each registered viewer will be tracked when they log in with their name and email address. The webcast link will expire once the attendee has satisfied the CE requirement. CE credits will be applied to their record on a periodic basis and a certificate of attendance will be available on each attendee's My ASPPA page.

ABOUT THE SPEAKERS

Audrey W. Chan
Audrey is the Voluntary Fiduciary Correction Program (VFCP) coordinator for the San Francisco Region of the Employee Benefits Security Administration (EBSA). As the Regional coordinator her responsibilities include creating Program awareness, providing Program guidance and reviewing applications for eligibility and completeness.  After 6 years in the Human Resources Office, Ms. Chan joined EBSA in 1999 as a Benefits Advisor, providing technical advice to the public and businesses on a variety of pension and health plan issues related to the Employee Retirement Income Security Act (ERISA).  Subsequently, Ms. Chan became an investigator and served as the Employee Contributions Project Baseline project coordinator before her current position as the VFCP coordinator.

R. Bradford Huss, Esq.
Brad is a member of the San Francisco law firm of Trucker Huss, a professional corporation, which practices exclusively in the areas of ERISA and employee benefits. He concentrates his practice on ERISA litigation, qualified pension and profit sharing plans, as well as IRS and DOL audits of employee benefit plans.

Brad received his BA degree from the University of California at Berkeley and his JD degree from Boalt Hall School of Law at the University of California at Berkeley. He is a Member of the Board of Directors of ASPPA and is a charter fellow of the American College of Employee Benefits Counsel. Brad is also a Past President of the San Francisco Chapter of the Western Pension & Benefits Conference. He is also a member of the State Bar of California, the American Bar Association and the Bar Association of San Francisco.
