PBGC Seeks Nominations for Advisory Committee Seat

The Pension Benefit Guaranty Corporation (PBGC) has announced that it is soliciting nominations for appointment to its Advisory Committee. The term of one of the committee members representing the general public will have expired; therefore, the PBGC is seeking nominations for one seat. 

The Advisory Committee

Section 4002(h) of ERISA provides for the establishment of an Advisory Committee to the PBGC. Its duties include advising the PBGC regarding its policies and procedures concerning investment of money and other issues the PBGC may request or as the Advisory Committee determines appropriate. The committee meets at least six times each year,  at least one of which is a joint meeting with the PBGC Board of Directors. 

Members. The Advisory Committee consists of seven members appointed by the President from among individuals recommended by the PBGC Board of Directors, which consists of the Secretaries of Labor, Treasury and Commerce. Committee members must have experience with (1) employee organizations, (2) employers that maintain pension plans, (3) administering or advising pension plans, or (4) in related fields. Appointments are for three-year terms. Reappointments are possible, but are subject to the appointment process. 

The Advisory Committee members are as follows: 

  • two representatives of employee organizations; 
  • two representatives of employers that maintain pension plans; and 
  • three representatives of the public. 

Limitations. No more than four members of the Committee shall be members of the same political party. Anyone currently subject to federal registration requirements as a lobbyist is not eligible for appointment. 

Nominations 

The PBGC must receive nominations by 45 days after the publication of the announcement in the Federal Register; publication is set to occur on Feb. 11, 2021. 
Nominations, including supporting letters, should: 

  • state the candidate’s qualifications to serve on the committee; 
  • state that the candidate will accept appointment to the Advisory Committee if offered; 
  • include the candidate’s full name, work affiliation, mailing address, phone number and e-mail address; 
  • include the nominator’s full name, mailing address, phone number, and e-mail address; and 
  • include the nominator’s signature, whether sent by e-mail or otherwise.
