ASPPA Webcast on Proposed Long-Term Part-Time Employees Regulations Available on Demand

On Nov. 24, 2023, the Department of Treasury and IRS released a proposed regulation (Prop. Reg.) providing much-anticipated long-term part-time employee (LTPTE) guidance. The Prop. Reg. outlines special rules for individuals participating as LTPTEs, which affect coverage tests, nondiscrimination tests, top-heavy contributions, and vesting computations. These rules become effective for most 401(k) plans on Jan. 1, 2024, and may have a significant impact on design decisions and plan administration for many plan sponsors.

In the webcast, Kelsey Mayo, JD, Director of Regulatory Affairs for the American Retirement Association and a Partner at Poyner Spruill, LLP, reviews the rules applicable to long-term part-time employees and highlights insights on the recent proposed regulations. The webcast illustrates the rules through a number of case studies, and discusses practical administrative issues the new rules raise.

Learning Objectives

The learning objectives for the webcast include the following:

1. Define a long-term part-time employee (LTPTE).
2. Calculate when employees may be eligible to enter as LTPTEs for differing plans.
3. Understand the vesting rules that apply if anyone enters the plan as an LTPTE.
4. Identify administrative issues and practical options to avoid errors.
