On June 26, 2013, the United States Supreme Court overturned Section 3 of the Defense of Marriage Act (“DOMA”).  As a result, same-sex married couples must be recognized by the Federal government (at least those that were married in the states that permit such marriages).  However, it is not clear which Federal rights and responsibilities of marriage will be afforded to same-sex married couples that reside in states that do not permit or recognize same-sex marriages.  This potentially disparate treatment of same-sex married couples based on their state of residence will have a direct impact on 403(b) and other employee benefit plans.  Please join the Assistant General Counsel of ASPPA, Ronald J. Triche, Esq., APM, as he discusses the case, its impact on employee benefits, and the many questions left unanswered by the Court.

The webcast is designed to offer registrants 2 ASPPA CE credits.

Enrolled Actuaries

The webcast is designed to offer registrants 2 JBEA CE credits for Enrolled Actuaries. The final decision as to the number and type of JBEA credits rests solely with the Joint Board for the Enrollment of Actuaries.

Enrolled Retirement Plan Agent (ERPA)

The webcast is designed to offer registrants 2 ERPA CE credits. The final decision as to the number of ERPA credits rests solely with the Internal Revenue Service.

Continuing Education Changes for RECORDED Webcast Attendees

Once registered, attendees will receive a confirmation letter directing them to the “Access Recorded Webcasts” page with a link to the WebEx OnDemand Center. Each registered viewer will be tracked when they log in with their name and email address. The webcast link will expire once the attendee has satisfied the CE requirement. CE credits will be applied to their record on a periodic basis and a certificate of attendance will be available on each attendee's My ASPPA page.

ABOUT THE SPEAKERS

Craig P. Hoffman, Esq., APM

Craig is the General Counsel and Director of Regulatory Affairs for the American Society of Pension Professionals and Actuaries (ASPPA). Craig has previously served ASPPA as President, Co-chair of the Government Affairs Committee and Co-chair of the Political Action Committee. Prior to joining ASPPA, Craig served for over 20 years as General Counsel for SunGard Relius LLC., and before that, was in private practice, specializing in the areas of taxation, ERISA, and employee benefits. He received both his JD and his LLM in Taxation from the University of Florida. Craig has spoken at numerous meetings on the subject of qualified pension and retirement plans, including the American Society of Pension Professionals and Actuaries Annual Meeting, the Society of Actuaries Annual Meeting; the Enrolled Actuaries Annual Conference; the American Law Institute/American Bar Association seminar in Scottsdale, Arizona; the New York Employee Benefits Conference; the Creative Pension Seminar sponsored by the Ohio State University College of Law; and the UMKC Law School Annual Employee Benefits Institute. In addition, he was an expert speaker at the first Saver Summit, jointly sponsored by the White House and Congress. Presently, Craig serves on the editorial boards of the Journal of Pension Benefits (Panel Publishers) and the Journal of Pensions Management (Henry Stewart Publications). He was a charter member of the first IRS Advisory Committee on Tax Exempt and Governmental Entities. He is also a Fellow in the American College of Employee Benefits Counsel. Craig’s articles have been featured in numerous publications, including The Pension Actuary, Journal of Compensation and Benefits, Journal of Pension Benefits, Pension and Benefits Week, Pension World, and RIA Pension Alert.

Ronald J. Triche, Esq., APM

Ronald serves as Assistant General Counsel and Director of Government Affairs for ASPPA. In his role as Director of Government Affairs, he manages the ASPPA Government Affairs Committee and develops regulatory comments through a committee process, drafts summaries of agency guidance and presents ASPPA’s position to agencies such as the DOL, IRS, PBGC, SEC and on Capitol Hill. Prior to joining ASPPA, Ron was a shareholder at Trucker Huss in San Francisco, where he practiced in the areas of ERISA and qualified plans for 12 years.
