EBSA Seeks Nominations for Advisory Council

The Department of Labor’s Employee Benefits Security Administration (EBSA) has announced that it is seeking nominations for open positions on the Advisory Council on Employee Welfare and Pension Benefit Plans. 

More commonly known as the ERISA Advisory Council, the Council’s duties are to advise the Secretary of Labor concerning carrying out his or her functions under ERISA, and to accordingly make recommendations to the Secretary. The Council meets at least four times each year.

The Council consists of 15 members appointed by the Secretary of Labor, no more than eight members of whom can be members of the same political party. These members are as follows:

  • three representatives of employee organizations (at least one of whom shall be a representative of an organization whose members are participants in a multiemployer plan); 
  • three representatives of employers (at least one of whom shall be a representative of employers maintaining or contributing to multiemployer plans); 
  • three representatives from the general public (one of whom shall be a person representing those receiving benefits from a pension plan); and 
  • one representative each from the fields of insurance, corporate trust, actuarial counseling, investment counseling, investment management, and accounting. 

Council members are appointed for three-year terms. The terms of five Council members expire at the end of this year. The groups or fields they represent are 

  • employee organizations; 
  • employers; 
  • the public; 
  • insurance; and 
  • accounting.

Nominations will be accepted for 45 days after the announcement appears after it is published in the Federal Register, which is set to take place on Aug. 19, 2022.
