Abandoned Plans

What happens when a retirement plan sponsor goes out of business, is liquidated in bankruptcy, or otherwise disappears from the face of the earth, leaving a retirement plan with assets behind?  What can be done to terminate the plan and distribute assets to participants?  Who can authorize distributions?  Is there any protection from fiduciary liability for a "good samaritan" who steps in to clean up the mess?  Jim will answer these questions and more as he reviews the DOL rules for designating a plan as "abandoned", taking on the role of a Qualified Termination Adminstrator, and distributing plan assets, along with newly proposed regulations that will cover plans of companies in bankruptcy.

Continuing Education Changes for RECORDED Webcast Attendees
Once registered, attendees will receive a confirmation letter directing them to the “Access Recorded Webcasts” page with a link to the WebEx OnDemand Center. Each registered viewer will be tracked when they log in with their name and email address. The webcast link will expire once the attendee has satisfied the CE requirement. CE credits will be applied to their record on a periodic basis and a certificate of attendance will be available on each attendee's My ASPPA page.

ABOUT THE SPEAKER

James C. Paul, Esq., APM
James (Jim) is a benefits attorney and a partner with Ferenczy + Paul LLP.  He heads up the Sacramento, California office, joining with the Atlanta, Georgia office to provide clients with advice and consultation regarding qualified pension and profit sharing plans, nonqualified plans, executive compensation and other benefit programs.  A benefits practitioner for more than twenty-five years, Jim provides practical and understandable guidance, advice, and support for employers, plan sponsors, and other clients.  He is a member of the State Bars of California and Arizona, and earned his law degree from the Georgetown University Law Center in 1987.  In 2010, Jim’s peers elected him to membership in the American College of Employee Benefits Counsel, the highest honor awarded to ERISA lawyers.

From 401(k) plan compliance and corrections, to executive compensation, to due diligence and counseling employers on benefits issues in mergers and acquisitions, Jim has done almost everything in the employee benefits arena.  His experience includes counseling employers on design, compliance, and operation of qualified retirement plans, nonqualified deferred compensation plans, welfare plans, and stock based compensation plans.  He also counsels employers on fiduciary issues and has experience in fiduciary litigation.

Jim serves on the Board of Directors for the American Society of Pension Professionals and Actuaries (ASPPA) and recently completed a term as Co-Chair of the ASPPA Government Affairs Committee.  He also currently serves on the Board of Directors for KVIE Public Television in Sacramento, and he frequently speaks and writes on employee benefit plan issues.
