Relief for retirement plans has been moving quickly since the declaration of the national emergency on March 13, 2020.  The enactment of the CARES Act and regulatory guidance have provided some welcome relief for both plan sponsors and participants. In this session we’ll review the provisions of the law that impact retirement plans as well as the latest guidance we have received from the IRS and DOL  Attendees will:

•    Learn the details of the distribution and loan provisions now available.
•    Funding relief that is applicable to some plans.
•    Learn which government filings have deadlines that are extended.

DOL regulations regarding electronic disclosure will affect how plan notices are provided. In this session, we’ll review the requirements and what practitioners need to be aware of as they are implemented. We’ll also discuss common questions that arise about specific forms, such as beneficiary designations and safe harbor notices. Attendees will:


•    Learn the rules associated with electronic disclosure.
•    Examine how safe harbor notices are affected by the SECURE Act.
•    Learn what to look for in beneficiary designations that can cause problems later.

The SECURE Act is the most comprehensive change to retirement plans in more than a decade; and some of its provisions have already taken effect, which makes it a great time to take a closer look at how the new law will affect plan design and operation.  In this session, we’ll review some of the key provisions and how they will affect plan administration.  Attendees will:

•    Learn how the new safe harbor 401(k) rules may be utilized.
•    Review some of the changes that will affect distributions.
•    Learn how the filing requirements and penalties may impact governmental reporting.

Brian H. Graff, Esq.

American Retirement Association (ARA)

Brian H. Graff, Esq., is the Chief Executive Officer of the American Retirement Association (ARA), the umbrella organization for the American Society of Pension Professionals and Actuaries (ASPPA), the American Society of Enrolled Actuaries (ASEA), the National Association of Plan Advisors (NAPA), the National Tax-deferred Savings Association (NTSA), and the Plan Sponsor Council of America (PSCA). Graff oversees ARA’s operations and, working with the Board of Directors, charts the strategic direction for the organization. Graff also serves as the Executive Director of ASPPA and NAPA. An attorney (District of Columbia) and certified public accountant (New York-inactive), Graff was formerly legislation counsel to the U.S. Congress Joint Committee on Taxation where he provided policy and technical analysis relating to employee benefits, health care and Social Security to members of Congress. While working for Congress, Graff participated in the development of legislation, including the Small Business Job Protection Act of 1996 and the Health Insurance Portability and Accountability Act of 1996. Graff received his doctoral degree in law, cum laude, from the University of Pennsylvania Law School in Philadelphia. He holds a Bachelor of Science in accounting with distinction from Cornell University in Ithaca, NY.

   

Bob Kaplan, CPC, QPA, CFP

American Retirement Association (ARA)

Bob Kaplan joined the American Retirement Association as director of technical education in 2017. Bob was previously a co-chair of the ASPPA Government Affairs Committee and a member of ASPPA’s Leadership Council. He also previously served as a member of the Board of Managers of the American Institute of Retirement Education, as well as the Board of Directors of the National Institute of Pension Administrators. Bob has provided testimony before Department of the Treasury on 401(k) issues and other retirement plan issues, and has more than 39 years of experience in retirement plan services, including plan design, administration, sales and consulting.

 Kelsey N. H. Mayo, J.D., is the lead employee benefits partner with Poyner Spruill LLP, a law firm based in North Carolina and serving clients nationwide.  She works with TPAs, business owners, and HR executives to understand and manage employee benefits and executive compensation arrangements.  Kelsey routinely represents clients before government agencies, and has extensive experience in virtually all aspects of employee benefit plans and executive compensation arrangements.  She serves on ASPPA’s Government Affairs Committee as the Chair of the IRS Subcommittee and regularly presents for ASPPA.

Robert Richter, J.D., LL.M., is retirement education counsel for the American Retirement Association (ARA). In this capacity he serves as subject matter expert for several training courses, publications and virtual events. Robert was previously a vice president with FIS Wealth & Management, where he managed the consulting department and was instrumental in authoring and supporting SunGard Corbel's retirement plan documents. He is an ARA past president, and is a member of numerous other organizations, including the Florida Bar and the American College of Employee Benefits Council
