ASPPA Webcast: 'Tis the Season: Advanced ADP and ACP Testing Techniques

Description:  As the holiday season ends, the 401(k) plan testing season begins providing risks, opportunities, and headaches for TPAs, recordkeepers, and plan sponsors. While the ADP and ACP tests are generally straight-forward, they do feature tricks and traps for the practitioner. This program offers a fast-paced discussion of testing and correction techniques, including disaggregation, shifting, recharacterization, the use of QNECs and QMACs and more. Recent law changes have brought us the opportunity to retroactively adopt safe harbor provisions to avoid failed testing results, adding even more options to the address failures. This session will provide valuable information to any practitioner working on non-safe harbor 401(k) plans.

  1. Administer ADP and ACP tests accurately    
  2. Identify strategies to improve the ADP/ACP test results
  3. Determine the best method to correct ADP/ACP test failures

About the Speaker: David Schultz, J.D. is an attorney, educator, and product manager with FIS in Atlanta, Georgia.  His more than 25 years of experience in the industry includes service as an ERISA attorney, the manager of a TPA and recordkeeping firm, an investment advisor focused on qualified plans, and a fiduciary consultant.  David is a member of the Government Relations Committee of the SPARK Institute and former Chair of the Government Affairs Committee and Administrative Relations Subcommittee of the American Society for Pension Professionals and Actuaries’ (ASPPA) Government Affairs Committee.  David earned a BS with a major in Finance from the University of Florida, his Juris Doctor from Georgia State University, and is a member of the State Bar of Georgia.
