Description: The US Department of Labor issued final rules in April 2020 to modernize and streamline communication from plan sponsors to participants using electronic options such as e-mail and the internet. This bold move is a major jump from the 2002 regulations as most people were just beginning the use of electronic means of communication. This insightful webcast will explain the final rules (including how they differed from the 2019 proposal), how they mesh with the 2002 safe harbors, and how your plan sponsors can utilize the final rules to provide certain ERISA-required notices.  We will hear both from a legal perspective as well as a recordkeeping perspective on how to implement the US Department of Labor’s streamlined electronic methods of communication. This webcast will help you understand the requirements needed to meet the safe-harbor and successful practices to communicate the retirement plans benefits to employees.

Kelsey Mayo is a partner with Poyner Spruill LLP, a law firm based in North Carolina. Her practice is focused in the areas of Employee Benefits and Executive Compensation. She routinely represents clients before the Internal Revenue Service, Department of Labor, and Pension Benefit Guarantee Corporation and has extensive experience in virtually all aspects of retirement, benefit, and executive compensation arrangements. Kelsey has a particular love for qualified and non-qualified pensions—so much so that she’s now passed 5 of the exams necessary for her ASA designation. As icing on the retirement-plan-geek cake, Kelsey spends her free time serving on both ASPPA and ACOPA's Government Affairs Committees and co-editing the Journal of Pension Benefits.

 

 

Frank Porter

Head, Institutional Business Development

Frank Porter is Head of Institutional Business Development for Empower Institutional. In his role, he is responsible for helping clients grow their businesses and realize their goals and objectives through the creation of tailored recordkeeping solutions. He also works with prospective clients to help them understand how Empower services and solutions can benefit them.

Frank joined the organization in 1993 and has an extensive background in retirement plan administration and consulting. He specializes in defined contribution/defined benefit plans and has considerable experience in relationship management, sales consulting, product management and development, plan design, plan implementation, compliance testing, and recordkeeping.

Frank currently serves as President-elect of the American Society of Pension Professionals and Actuaries (ASPPA). He is also a Leadership Council board member and Co-Chair of the ASPPA Government Affairs Committee as well as an author and speaker on trending topics related to retirement.

Frank holds the Accredited Pension Administrator (APA) designation from the National Institute of Pension Administrators (NIPA) as well as the Qualified 40(k) Administrator (QKA) and Qualified Pension Administrator (QPA) designations from the ASPPA.
