New Comparability Plans: The Potential Detrimental Impact of IRS-Proposed Regulations

On Jan. 29, the IRS released proposed regulations that are expected to significantly affect the design and economics of defined contribution plans that test for nondiscrimination on the basis of equivalent benefit accrual rates. These plans are often referred to as “new comparability” or “cross-tested” plans. They have become very popular with small business over the last 30 years. The new proposal, should it take effect, may change that dynamic.

In the Feb. 22 webinar “New Comparability Plans: The Potential Detrimental Impact of IRS-Proposed Regulations!,” Judy Miller and Craig P. Hoffman of the American Retirement Association and Tom Finnegan of The Savitz Organization reviewed the “cross-testing” rules and explained how they would change under the proposal. They also discussed the reasons for the IRS proposal, what ASPPA and ACOPA’s Government Affairs Committees are doing about it, and how members can help those committees respond.
