ASPPA Webcast: Participant Loans: The Fine Print

Description : Participant loans have become a nearly standard feature in retirement plans, but loans touch on many different aspects of plan compliance and regulation.  From prohibited transactions to deemed distributions, loan offsets and more, the administration of participant loans is a complex task.  This seminar will provide an overview of the participant loan rules, along with in-depth discussion of common issues, traps, and areas of potential confusion.

Learning Objectives: 

  1. Describe the options available in designing and administering participant loans     
  2. Correctly report and address participant loan issues and defaults
  3. Advise a client on avoiding prohibited transactions involving participant loans

About the Speaker: David Schultz, J.D. is an attorney, educator, and product manager with FIS in Atlanta, Georgia.  His more than 25 years of experience in the industry includes service as an ERISA attorney, the manager of a TPA and recordkeeping firm, an investment advisor focused on qualified plans, and a fiduciary consultant.  David is a member of the Government Relations Committee of the SPARK Institute and former Chair of the Government Affairs Committee and Administrative Relations Subcommittee of the American Society for Pension Professionals and Actuaries’ (ASPPA) Government Affairs Committee.  David earned a BS with a major in Finance from the University of Florida, his Juris Doctor from Georgia State University, and is a member of the State Bar of Georgia.
