Description: ERISA litigation continues to rise despite the pandemic and 2022 is no exception. In fact, more plans than ever are facing class action lawsuits relating to excessive fees. However, excessive fees are not just the only issues pending before the Courts. The use of participant data, managed account services and proprietary funds have all been recent litigated issues.
