What's the Topic?

The Department of Labor’s (DOL) proposed fee disclosure regulation (under ERISA §408(b)(2)) contains sweeping changes on what constitutes a reasonable contract or arrangement for service providers and employer-sponsored retirement plans. Failure to comply with ERISA §408(b)(2) will cause service provider arrangements to be treated as prohibited transactions unless the service provider has a written arrangement with the responsible plan fiduciaries and makes extensive disclosures about its direct and indirect revenues and about any potential conflicts of interest. The DOL has announced plans to finalize this proposed regulation by the end of 2008, so it is crucial you understand the basics of this proposed regulation!
