What's the Topic?

This will be a practical review of Internal Revenue Code (Code) §409A and recently published final regulations governing executive deferred compensation plans and similar arrangements. The discussion will be a "nuts and bolts" approach to how to recognize and deal with common business agreements and practices that are now treated as nonqualified deferred compensation arrangements. It will provide an overview for TPAs, consultants and others who don't normally specialize in nonqualified deferred compensation plans. We are pleased that Dan Hogans, Attorney Advisor, Office of Tax Policy, U.S. Department of Treasury, will be part of our panel.

Join Dan Hogans and Jim Paul, APM, Downey Brand, LLP in a discussion of many of the practical implications of these new regulations, such as:

  • What types of plans or arrangements are now subject to §409A
  • Exceptions, including rules for severance pay plans
  • General rules for compliance
  • Highlights of changes made in the Final Regulations
