HR 5297-The Small Business Jobs Act of 2010

The Small Business Jobs Act of 2010, as passed, contained a provision which affects retirement planners by permitting individuals to rollover funds from the tax-deferred portion of their group retirement plan to the plan's Roth account.

Under the new law, retirement plan participants can now rollover funds in their 401(k), 403(b), and 457(b) plans to a designated Roth account inside their group plan. Funds rolled over to the Roth section of their plan in 2010 will be eligible to spread out the Roth conversion income over two years (2011 and 2012), or to choose to include the entire amount of the rollover on their 2010 return.
