In 2009, 403(b) arrangements became subject to both new regulations from the IRS and increased annual reporting obligations for ERISA plans overseen by the Department of Labor (“DOL”). This has caused employers and practitioners to have many questions with regard to their new responsibilities. The DOL has responded with a series of Field Assistance Bulletins (“FABs”) in an effort to provide answers. Final regulations provide new rules for how the AFTAP is determined, when it must be re-determined, and when a change in AFTAP is “deemed” immaterial. Little is more fundamental to plan administration than correctly determining the compensation of employees. Yet it is a widely misunderstood topic, as the one word, "compensation," can mean many different things, even within a single plan, depending on the context of the situation. Misstating compensation can result in IRS Code Section 415 violations, nondeductible contributions, incorrect allocations and prohibited discrimination.
