For past year, the retirement world has focused on a key question – do my services make me a fiduciary? With the Department of Labor’s final rule on the definition of fiduciary, the discussion now shifts to a long-standing but more important than ever question – if I am a fiduciary, is what I’m doing creating prohibited transactions? Disclosure is not a cure-all for many prohibited transaction. This presentation will focus on prohibited transaction issues service providers may need to focus on as they move forward.

About the Speaker:

David Levine is a principal with the Groom Law Group. In this capacity, he advises plan sponsors, advisors, and other service providers on a wide range of employee benefits matters, from retirement and executive compensation to health and welfare plan matters. He is the immediate Past Chair of the IRS Advisory Committee on Tax Exempt and Government Entities (ACT) and current Chair, Legislative Subcommittee, Employee Benefits Committee, Tax Section, American Bar Association.
